Introduction
SYMMETRIC TECHNOLOGIES, INC. (“SYMMETRIC” or “we”, “us” or “our”) owns and operates the website found at the URL www.buildalesson.com
(“Build a Lesson”), an online lesson builder. All digital content used to build lessons, and all images, samples, and descriptions of that content, found on Build a Lesson and provided by the owners of that content, are
collectively referred to as “Teacher Content” in this Privacy Policy;
the owners are referred to as “Teachers.”
SYMMETRIC offers access to Build a Lesson subject to
its Terms of Use, which incorporate this Privacy Policy. This Privacy
Policy describes how we collect, use and safeguard the information you
may provide to us while using Build a Lesson. By accessing Build a Lesson, you are accepting the Terms of Use and this Privacy
Policy and agreeing to be bound by them. If you do not agree with this Privacy Policy, do not use Build a Lesson.
As required by the Children’s Online Privacy
Protection Act, Build a Lesson does not permit children under 13 years
of age to become registered users. By using Build a Lesson, you
represent that you are not under 13 years of age.

Types of Information We Collect
When you use Build a Lesson, SYMMETRIC may collect from you personally identifiable information (“PII”) and technical and other information that is not PII.
You may use Build a Lesson without registering with
us. In that case, we do not collect any PII from you; our system
records only your computer’s IP address and your activity while using Build a Lesson.
If you wish to post messages in any Build a Lesson
discussion forums, you may be asked to provide your name and email
address, and to select a user name and password. Doing so will not
register you as a Build a Lesson user. You will not be required to
register as a Build a Lesson user to participate in our discussion
forums.
If you wish to create lesson on Build a Lesson, you must register as a Build a Lesson user (“Registered User”). To become a Registered User,
you must at a minimum provide your name and email address, and select a
user name and password; we may ask Registered Users for additional
optional information on the “My Account” page.
In order to pay for the Build A Lesson service, Teachers must provide “Billing Information” as
required by our Payment Services Providers, defined below. Depending on
the payment method selected by the Buyer, Billing Information may
include billing name, billing address, credit card information
(including card type, card number, expiration date and verification
code) and PayPal email address. We may record and store certain billing
information for reporting purposes; however, in no case will we store
credit card verification codes or more than the last 4 digits of your
credit card number, if provided.
How We Collect Information
We collect PII from you by expressly requesting it
from you at the time you register as a Registered User. It is your responsibility to
make sure that this information is accurate, complete, and current. You
may update Registered User information from
time to time by accessing your account and making changes on the “My
Account” page.
We may also collect other information through
“cookies” — parcels of text sent by Build a Lesson to your browser
which then returns them unchanged each time you access Build a Lesson.
We use cookies to authenticate your digital identity and to learn your
site preferences as well as to track Affiliate referrals and for
statistical and reporting purposes. Registered Users must have cookies enabled to sign up and
access their accounts.
What Happens If You Choose Not to Provide PII
You may, of course, elect not to provide us with your
PII, but this may result in your inability to fully use and enjoy the
features and functionality of Build a Lesson.
How We Use Information
We retain and use the information Build a Lesson collects for legitimate business purposes only, such as
- To bill Teachers for the use of the Build a Lesson service;
- To perform our obligations under United States federal and state income tax and other laws;
- To correspond with Teachers regarding Build a Lesson;
- To monitor site usage and traffic patterns and comply with our
Terms of Use; and
- To inform Registered Users of new products and services of SYMMETRIC and its affiliates
and subsidiaries.
We do not sell or rent your PII to third parties but
reserve the right to share PII with our business partners. Also, we may share in aggregate, statistical
form, non–personal information regarding the visitors to our site,
traffic patterns, and site usages with our partners, affiliates or
advertisers. In addition, we will disclose information we maintain,
including PII, when required to do so by law, or may disclose such
information in response to a request from a law enforcement agency or
authority.
You may opt out of receiving messages from our business partners and us by emailing us at legal@buildalesson.com.
How We Protect Your Information
SYMMETRIC employs computer security systems, methods
and procedures and uses other reasonable efforts to protect your
information from unauthorized disclosure; because of the inherent
nature of the Internet, however, this does not and cannot guarantee
security for the information you transmit using Build a Lesson. And
these security precautions do not apply to your thoughts, comments,
suggestions, and criticisms that you post, upload, or
transmit to Build a Lesson (“User Content”).
As a Registered User,
you have responsibilities to protect yourself as well. You must not
share your password with anyone. If you suspect unauthorized access to
or disclosure of your information, you must contact SYMMETRIC
immediately.
SYMMETRIC will never ask you to reveal your password
in written or electronic communications. We will only ask you for your
password when you contact us and only in cases where it is required to
assist you in resolving your question or concern.
Third Party Information Practices
SYMMETRIC has arrangements with one or more third
party online payment services providers (“Payment Services Providers”)
who process Teachers' payments for use of the Build a Lesson service. The privacy of your PII under that circumstance is subject to the
privacy policies and procedures of that Payment Service Provider. You
should review the privacy policies posted on the site of the Payment
Service Provider; SYMMETRIC does not control, nor are we responsible
for, the privacy policies or information practices of Payment Service
Providers.
SYMMETRIC may also reference or provide links to
third party websites on Build a Lesson. We are not responsible for the
third party websites, and you should review their privacy policies;
SYMMETRIC does not control, nor are we responsible for, the privacy
policies or information practices of these third parties.
Modification
We may modify any of the terms and conditions
contained in this Privacy Policy, at any time and in our sole
discretion, by posting a change notice or a new Privacy Policy on Build a Lesson. These modifications are binding at the time of posting.
Each time you access Build a Lesson you should check this Privacy
Policy to see these changes, because by accessing Build a Lesson you
are accepting these changes and agreeing to be bound by them. If you
wish to opt–out of these changes, you may do so at any time by
terminating your account status with us. If you are not a Registered User and you do not wish to agree to these changes,
then you must discontinue your use of Build a Lesson. IF ANY
MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE
YOUR ACCOUNT OR TO DISCONTINUE USE OF BUILD A LESSON. YOUR CONTINUED
USE OF BUILD A LESSON FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW
PRIVACY POLICY ON BUILD A LESSON WILL CONSTITUTE YOUR BINDING
ACCEPTANCE OF THE CHANGE.
